Privacy notice – home to school transport

North Somerset Council is registered with the Information Commissioner’s Office for the purposes of processing personal data. The home to school transport service is administrated on behalf of North Somerset Council by our partner Agilisys Ltd.

The information you provide will be held and used in accordance with the requirements of UK and European data protection law. The information will form part of your child’s home to school account, and held for the period that they remain in that stage of their education (for example until they leave primary school or secondary school).

Unless otherwise agreed with you, we will only collect the minimum personal data required to deliver the service, which includes child’s name date of birth, home address and school attended, applicant name address and contact information, and details of medical conditions, including mental capacity. It does not include information relating to criminal convictions or offences.

The information will be used for the administration of the home to school transport service; our statutory duty under Sections 444, 508A, 508B, 508C, 508D, 509AD and Schedule 35B of the Education Act 1996 (the Act), as inserted by Part 6 of the Education and Inspections Act 2006 (the EIA 2006), Regulation 5 and Part 2 of Schedule 2 to The School Information (England) Regulations 2002, as amended, Equality Act 2010, School Admissions Code, European Convention on Human Rights, The School Travel (Pupils with Dual Registration)(England) Regulations 2007, Public Service Vehicles (Carrying Capacity) Regulations 1984,

Section 48 of the School Standards and Framework Act 1998, in accordance with Article 6(1)(c) of GDPR. The processing of the special category data is lawful under Article 9(2)(g) of GDPR, as it is necessary for reasons of substantial public interest, in accordance with the School Admissions Code, to ensure adequate school and transport arrangements for your child.

We will not use your personal information in a way that may cause you unwarranted nuisance. Failure to provide the information could result in our inability to assess your eligibility for home to school transport provision.

The information provided will be shared with our home to school transport providers to ensure the service is delivered appropriately to you. The information may be shared with special educational needs, education welfare and school admissions teams, who have demonstrated that they have a lawful and legitimate interest in the information. We also have a legal obligation to share information with our local Safeguarding Board or the police, where we have legitimate concerns about a child’s welfare. Your data is never shared or processed outside of the UK.

We may lawfully disclose information to public sector agencies to prevent or detect fraud or other crime, or to support the national fraud initiatives and protect public funds under the Local Audit and Accountability Act 2014. Under the conditions of the Digital Economy Act 2017, we may also share personal data provided to us with other public authorities as defined in the Act, for the purposes of fraud or crime detection or prevention, to recover monies owed to us, to improve public service delivery, or for statistical research. We do not share the information with other organisations for commercial purposes.

You have the right to see the personal data we process about you, as well as the right of rectification, or restriction to destruction of records only.
